Terms of Service
Welcome to PromptAndWear. These terms govern your use of our AI-powered design platform. We've designed them to be as clear and fair as possible.
1. Acceptance of Terms
By accessing or using PromptAndWear (the "Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our Service.
These Terms apply to all users, including visitors, registered users, Pro subscribers, and Enterprise customers. Additional terms may apply to Enterprise agreements.

2. Eligibility
You must be at least 13 years old to use PromptAndWear. Users between 13 and 18 years old must have permission from a parent or legal guardian.
By creating an account, you represent and warrant that:
- You meet the age requirement
- All registration information you provide is accurate and current
- You will maintain the accuracy of such information
- You have the legal capacity to enter into this agreement
- You are not prohibited from using the Service under Colombian or applicable law
3. Account Registration & Security
To access certain features, you must create an account. You agree to:
- Provide accurate, complete, and current information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
Account Sharing ProhibitedEach account is for individual use only. Sharing passwords or account access is strictly prohibited and may result in immediate termination. Enterprise customers may create team accounts with proper authorization.
4. Subscription Plans & Billing
4.1 Available Plans
Trial (Free)
Limited features for testing. Designs remain property of PromptAndWear.
Pro
Full commercial rights. Own all your designs. Billed monthly/annually.
Enterprise
Custom features & licensing. Dedicated support.
4.2 Payment Terms
- Subscriptions are billed in advance
- Payment due upon subscription/renewal
- All fees in USD unless stated
- Fees non-refundable (except as legal req)
- Secure processing via Stripe/Wompi
4.3 Cancellation
- Cancel anytime via account settings
- Effective at end of billing period
- No partial month refunds
- You keep ownership of paid designs
* We reserve the right to modify pricing with 30 days' notice. Continued use implies acceptance.
5. Acceptable Use Policy
You agree to use PromptAndWear only for lawful purposes. You agree NOT to:
- Generate designs that infringe on intellectual property rights
- Create hateful, discriminatory, violent, or sexually explicit content
- Circumvent generation limits or restrictions
- Generate counterfeit goods or trademark-infringing designs
- Harass other users or staff
- Upload malware or viruses
- Scrape or data mine the platform
- Resell access without authorization
Violation ConsequencesViolations may result in content removal, account suspension, or permanent termination without refund. Serious violations may be reported to authorities.
6. AI & Content Moderation
While we employ safety filters, we cannot guarantee all AI-generated content will be appropriate.
6.1 Content Responsibility
- You are solely responsible for reviewing designs before use
- You must verify designs do not infringe third-party rights
- PromptAndWear is not liable for IP issues in AI-generated content
- We reserve the right to remove non-compliant content
7. Intellectual Property & DMCA
You retain ownership of prompts and customization inputs. By using the Service, you grant us a license to process your inputs to generate designs and improve our models.
Copyright Complaints (DMCA)
If you believe content infringes your copyright, send a notice to jdlopez@promptandwear.com containing your contact info and details of the infringement.
We investigate promptly and remove infringing content.
10. Disclaimers
Provided "As Is"
PromptAndWear makes no warranties, express or implied, regarding the Service. We do not guarantee:
- Accuracy or quality of AI designs
- Uninterrupted operation
- Fitness for a particular purpose
11. Limitation of Liability
To the maximum extent permitted by law, PromptAndWear S.A.S. shall NOT be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
Maximum Liability
Our total liability shall not exceed the greater of (a) amount paid in last 12 months, or (b) $100 USD.
13. Governing Law
Jurisdiction
Governed by the laws of the Republic of Colombia. Disputes resolved through binding arbitration in Medellín.
Consumer Protection
Colombian residents may file complaints with the Superintendencia de Industria y Comercio (SIC).
